Hit & Run Charges
In North Carolina, you may be charged with hit and run if you failed to observe certain actions after an accident has occurred. If you leave the scene of an accident without also taking the necessary steps to make things right, you might be charged with a hit and run. You are required by law to give reasonable assistance to make sure the other person is taken care of if there is an injury, and exchange information such as contact numbers and insurance companies in an accident.
In any hit and run offense, the category of the offense and penalties incurred all depend on the severity of the accident. If the accident results in only property damage and/or minimal injury, you will face Class 1 misdemeanor charges. This carries a sentence of up to 1 year in jail as well as hefty fines. If the hit and run results in a death, you’re going to face a Class H felony charge. This will typically be penalized with no more than 8 months in jail with no criminal background, and a greater sentencing with a criminal background. This sentence will be greater if you compound the hit and run with another offense such as driving with a revoked or suspended license or reckless driving.
